Kimbrough, Thomas M.
- Provides counseling and representation to Union and non-Union employers in every aspect of employee relations. Primary emphasis and goal is to resolve disputes, prevent litigation and to counsel clients in avoiding and solving personnel and labor-related problems.
- Exclusively represents, counsels and defends corporations and professional organizations concerning alleged discriminatory employment practices, wage and hour matters, wrongful discharge, occupational safety and health, employee privacy issues, drafting and enforcement of covenants not to compete and confidentiality agreements, employment contracts, Union organizational campaigns, arbitrations, negotiations, and proceedings before the National Labor Relations Board.
Admitted to practice before the Indiana state courts, the United States District Court for the Northern and Southern Districts of Indiana, the United States District Court for the Northern District of Ohio, the United State District Court for the Middle District of Florida, the United States District Court for the District of Connecticut, the United States District Court for the District of New Jersey, and the United States Court of Appeals for the Sixth and Seventh Circuit.
- Over 30 years of experience in defense of discrimination and employment related claims brought before the Equal Employment Opportunity Commission, Indiana Civil Rights Commission, and in the federal courts including, but not limited to, defense of claims based on The Americans With Disabilities Act, the Age Discrimination In Employment Act, the Fair Labor Standards Act, Title VII of the Civil Rights Act of 1964, claims based on race, sex, national origin and sexual harassment and the Employee Retirement Income Security Act.
- Extensive experience in assisting employers in preventing or defeating Union organization attempts. This includes conducting employer campaigns once a Union Petition For Certification has been filed.
- Experience in advising employers in contract negotiations, strikes, Union salting and claims brought before the National Labor Relations Board by disgruntled employees and/or Unions.
